a. Engaging in a pattern or practice of knowingly hiring or continuing to employ unauthorized aliens
Persons or entities who are convicted of having engaged in a pattern or practice of knowingly hiring unauthorized aliens (or continuing to employ aliens knowing that they are or have become unauthorized to work in the United States) after
November 6, 1986, may face fines of up to $3,000 per employee and/or six months imprisonment.
So the worst that could happen is that our friend ends up paying $3,000. Also note that I-485 will be in trouble if and only if the prison term in more than 1 year (or) if the beneficiary had failed to include his arrest record on his I-485 application. Besides that, there are many waivers available for first time convictions.
When USCIS is protecting illegal aliens through "U Visas", wouldn't they be considerate on a case involving the baby of a legal alien?
Going by the above, it makes sense for "thunderbolt" to take help from a qualified attorney and report this case to cops. Posting the video in youtube or bashing the Nanny is Sulekha/citysearch is all fine. But when you child grows up and asks what you did when he was abused as by the nanny, you don't wanna answer "Dear child! I took the video footage of the abuse, showed it to my friends and posted it on you tube and then I bashed her with my comments on sulekha/citysearch."
Hence if there's any justice to be done for the poor soul who couldn't even express himself, then take the evil nanny to cops. Or else you're just letting everyone to walk all over you like a doormat.

Your case may be preadjudicated.....(if at all that is actually true)....yet it does not stop USCIS from sending an RFE for anything especially it has been over a few months since they last saw ur case....and once an RFE is issued you again go back in the list and the wait continues to next year when the window again opens for a short time.
It is absolutely nonsense that preadjudicated cases are in a pile waiting for visa number...this is from my attorney....USCIS can issue n number of RFEs.....and each time it is issued it furthers the chance of green....

Is there a chance that mine pre-adjudicated? I attended the interview on Jun 25, 2009. The DAO asked me for various docs and I provided all those. Is there a chance of getting RFE still?

Thats wrong. This is not being posted by private people. It is being delivered and packaged by FTD/1800 flowers and such known company.

With all of the anthrax scares going on I'd be very surprised if they even allowed the flowers to be delivered to the building (especially if they are accompanied with get well soon cards). You may want to make sure that the flowers are being signed for and delivered before you send any more.

at some point the visa numbers are going to be all used up. The lucky ones would get their GC by then and the others will have to wait for a few months.
Why worry over it? The line only gets shorter and shorter and everybody will get their turn sooner than later.
As long as they don't waste any visa numbers, there is no need for any worry. Even their random processing order does not bother me that much, because demand for EB2 will be less than supply next year. Its time for EB3 to fasten the seat belts....

I googled to find any cases similar to the one I have now, by no luck.
My wife was out of status for more than 6 months while she was on H1-b by not working. To put her back on status, my attorney advised to make her go out of the country and come back on H4 visa. Her status now is H4 and has maintained it since the last entry to US. I have maintained my H1-B status since 3 years and got paid for every day.
Is it possible, my I-485 is approved (primary applicant) and her I-485 denied (dependent) due to her prior out-of-status on H1-B? Her current status as mentioned in the I-485 forms is H4.
Please advice.

We never received any email from you. I think you mean 4-5 posts. We did not believe that there was merit in responding to your posts. There is only so much time in a day. We can not practically respond to most of the posts, even if we want. But as I mentioned earlier, not responding to a post doesn't give you license to be rude and then later call it a joke. I believe there are more than one admin here, why dont one of you take couple of minutes atleast for the sake of putting a stop to this false accusations. Why dont you track our IP address for the past 1-2 days. You know we have been posting simultaneously, why do you please take a step to find out if these messages are coming from the same machine or even same vicinity. Please do this for our sake. I just talked to a NSC representative and he told me that my case is sent to extended review. Now what is this extended review?
Well, what annoys and confused me is that when I took Info pass day before yesterday she told me that my case is with IO. And now NSC rep is giving me another version called extended review.
Don't know whom to believe.
Does anyone here had same exp.
I talked to a TSC rep a couple days back and she told me that my case is under review. When pressed what it meant she told me I have to wait for some more time before action is taken on my case:confused:
