Hello ragz4u,
Thanks for opening this thread.I am sure there be plenty of struggling stories to inspire us fight till we reach our goals. I like the way you are giving small snippets of stories without compromising privacy of the person.
If we can get permission from the person to print these stories on IV website , that would be great read and inspire lot of members.
This person's company promoted him to IT Manager with huge hike and then he learnt from company attorney that he cannot change his role while his LPR is in process. He then got demoted to Sr.Software enginner from IT Manager and the hike was rolled back
This is truly the shocking reality of the life of legal immigrants. We need more and more such stories to pass on to our senators...please keep on sending these stories.....

Hydeboy is right.
My american employer rejected to file PERM after ads are posted. They were supposed to befiling in EB3 and they said they found candidates so they are not going to file green card...I am totally depressed..This is the true picture in almost all american companies. BEWARE of green card.

Yes...I am aware of the facts that you mention...but now that data entry is made since long, the ND has no value.
Last year when the EB2 PD's were current for 28 days in August, only those RD's whose data was entered in TSC had chance of getting GC's. In other words, receipts are now generated for all '07 fiasco filers and hence the ND has no value!
That said if a Service Center rep says about the ND replacing the RD in their system, then it is time for corrective action. With these small windows of PD being current, why take chances!

Let us say that i agree to what ever you say. In what way does everything you stated above make a STEM graduate eligible for GC without an Employer sponsership. Why does it have to be only STEM graduates which will not need employer sponsership. If giving GC based on completion of MS in us is bypassing the employee sponserhsip then that has to be extended to all EB categories of immigrants (EB1/EB2/EB3) and the benefit o those visas have to be passed to the badly retrogressed category first.

Ok, been thru this also recently.
As these days your photo comes printed in the passport unlike those old days when they used to affix the photo with gum. Hence, the new size 3.5 cm because i think they scan it and computer prints it.
To answer your question, at NY the correct size is 3.5x3.5 cm.
However, they are accepting 2x2's as well, but the downside is the computer cuts it to 3.5x3.5 cm hence showing ONLY your face without a little bit of neck or shoulder. This photo does not look good, i have seen this happen with the same guy that i mentioned in the above therad.
I took both 3.5x3.5 and 2x2, they didn't care, but i gave them 3.5x3.5 as it was stressed in the NY webpage.
Now, getting 3.5x3.5 cm photo is a PAIN. I went to PicturePeople and I had to find a really smart guy to do that job for me. At the counter, they just plainly refused to do that.

You need to understand that there are several issues that is being worked on. Discussion here is for administrative fix without any legislative intervention. What you are asking for is not possible as a administrative fix. We cannot go for all or none. In this thread we are concentrating on administrative fix. What is even more frustrating is that we are chasing this so called American Dream during the most potent years of our lives and literally wasting our lives away.
That's exactly it Ragz. That one statement summarized it all. The MOST potent and important years of our lives and our spouses lives are going Right down the drain. I feel even worse for the spouses. Atleast we HAVE jobs and our careers are going SOMEWHERE. The countless spouses on here and even more so not on here are suffering away today for a better tomorrow. It may just happen that when the Work permits/ GCs do come thru, our spouses' skills may be extinct due to having no work for so many months/years.
This is definitely an angle to explore. As my spouse was telling me the other day. God Forbid, if this problem lasts for another year and then some of us decide to move back coz we are tired of this nonsense, our spouses will find it just as hard to find jobs in our home countries as well. Think about it, our home countries are pumping out fresh blood everyday. Will the companies select them, or someone who has been out of touch with the job scene for 1-2 (or many more) years?

Its as simple as that. You can quote all the laws in the universe, and come up with all the fancy logic that you want. But what I have said above is what it all boils down to.
No one here takes advantage of any group. We are talking here is what law says and how it is implemented by various agencies. The problem is there is doubt that DOS has not understood the law. No one is against ROW and loves India and China. US immigration simply based on preference catagories. For example, wife of U.S citzen will be given first preference in immigration (FB1) compare to brothers and sisters of US permanent residents (FB4or5). This is the law.
Similar thing in employment catagories too. Before 2000, there is a verical spill over of EB visas. Becase of this, a high skilled workers from India/China has to wait more compare to low skilled workers from ROW. This practice will not put US in technological edge. Thats why AC21 law implemented.
After 2000, congress removed country quota in all EB catagoires. The simple reason is to make US competiveness in 21st century. The intend is simple.
The simple meaning of AC21 law is, for example, let us assume following hypothitical situation. There are 40,000 noble prize winners from Mexico. All of them applying EB1 visas in a FY. In same FY, no one from other countries applied EB1 visa. As per AC21 rule, entire 40,000 visas (100%) goes to Mexico in EB1 irrsepective of how EB2 or EB3 or FE catagories are retrogressed or howmany mexians in EB/FB are waiting. This is what congress intend to promote high skilled immigrants to USA. This is what american competivness in 21 century. The intent here is noble prize winners should not wait even if they are from oversubscribed countries like mexico.
If you read word by word of AC21 rule ..you will understand what I am saying.
