I have read in several forum that one cannot form own company and sponsor H1 through that. The logic is sponsoring H1 is work and you cannot work without H1.
I think it is acceptable logic. Otherwise many would have sponsored H1 for self.

i am with you. we should request that USCIS recapture unused visas!
Guys , I think this issue has been discussed lot of times.
1) USCIS do not allot immigrant visas, It is alloted by DOS.
2) DOS needs a fix in the current EB laws to capture unused visa.
3) I am not sure if we can push any change in law, given the current Iraq war quagmire.
But I hope they speed up the overall application processing times, with all the increased Fee money they will get from July 30th (by investing money on IT).

Before I go any further, please read my disclaimer. The views are soley directed towards local market I am aware of and interests in i.e. GMADA ( Punjab/ Chandigarh area) and in no-way should my views/ opionion be applied to flats in Bombay/ Banglore or Hyd etc. With that said, hear me out.
Their is and last year I first hand expereienced massive infrastrucutral development going on in Delhi as well as in Chandigarh/ Punjab area. Their are supposed to be some Asian or Commonwealth games to happen in 2010. In addition to that, for some great reasons it appears the states closer to national capital had been lacking in basic infrastructural development. Can you believe Bombay-Pune highway is in better conditions than Ludhiana- Delhi, National Highway #1!. FYI: NH-1, is India's historically first highway criss-corssing the country from West to East. So they are playing the catchup game.
With improved basic infrastructure, living and commuting from satillite cities has become much easier than it was 10 yrs ago. Just like sub-urbs here, people want to enjoy life-style that is un-affordable in city centers. The NRI spending clout has wanned in recent years due to rapid development and growth in India. So the babus, politcians, industrialists, cops, Rich middle-class etc are coming in and taking away most of the RE. In addition to that, the basic infrastrucutral development funded by Government is giving a lot of monies to people whose farming land is being acquired to setup airport or industrial/ residentail sectors. These recently cash-rich farmers are not investing back in buying adjoining farm land but also investing in urban properties. You won't believe, but people were compensated quarter million per acre for recent Mohali/ Chd airport expansion. On top of all this, they ever growing population and shrinking available land is organically raising the prices.
With all that going, why would you think RE investment would fail? Plus remember the age-old adage "... Land never fails you." Jats do it!

HLG has confirmed that the CIS is not returning I-485 Applications back to those who filed I-485 during the first week of July. This is leading many to speculate that the CIS may reverse course and re-re-amend the July Visa Bulletin; whether the Visa Bulletin actually reopens remains to be seen. HLG normally refrains from commenting on rumors, but we have talked to several Washington insiders and believe that this is seriously being considered.

I have seen so many in this forum spits on L1. This is really bad, we all belong to one family and one kind.
If some one thinks L1 is more advantagous why don't those people join TCS or some thing...
Well let me put some of the Disadv.
1. On L1 one canot change the job. If you want to change the employer you should have H1B
2. L1B salaries are 20% less than H1B on AVG
3. If employer want to send you back (For any silly stupid reason) you are gone
4. Most of the companies like TCS, INFOSYS, WIPRO won't file green cards for 99.99% people
5. On avg a L1 person stays in US in a trip for 1 - 2 years.
Now think!
And above all as I said all those L1 are living in this country legally like me and you, living a painful uncertain life. Because the time is bad now we can't blame them.
Some one talking about getting laid off with TCS employee. just recapture the 5 or 8 years back when you replaced a AMERICAN CITIZEN and you can't call people as idiots ... its street clear.

I saw the poll in the morning and voted FOR making this a paid site, but going through the discussions and a little bit of soul searching (slow day at work :p) i am a bit wary about making it a paid site now.
As much as i would like to see the riff-raff (pardon the expression) go away, maybe we should be more inclusive then exclusive (?). Not everyone is an early adoptor, it took me a while to contribute as well, but i did eventually turn around and contributed the lil bit i could.
Thats just my take, and excuse the rather altruistic title of my post.

I assume you've likely never studied in India though. An bachelor's degree in engineering is not very expensive, if you have good grades.
10 years back it would cost about $100-200 a year, if you qualified through a state ranking system.
i graduated more than 10 years ago...with an Engineering degree...i know about the $100-200 merit seats...which were extremely difficult to get. I could have gotten the merit seat in a lower ranked college but chose a better college. It applies to only the top 5% or less of the total applicants. You don't get to the top 5% without spending a small fortune in private coaching ...why... because your regular teachers hardly make an attempt to teach you well...and they are the same ones who make lot more money in private coaching.
Anyways even with the very little $100-200 "almost impossible to get" merit seats there are plenty of other expenses for engineering. This is out of the question if your family is not in lower middle class economically atleast.

I dont know if that's completely true. I had my H1B visa appointment on Dec 28th in Mumbai and am in the PIMS verification status also. The visa officer told me that all NIV applicants around the world have to go through the process and admitted that the process was new.
I talked to 3 other H1 candidates right after I was handed the yellow slip and they all had the same experience with different officers. Although its aggravating, hopefully, we'll all get some relief this week.

[Mr. Brown] True. If the plan B/C is not up to par with plan A then it is definitely hard to move on. Plan A (GC) gives you a grand standard of living but Plan B (India etc.) gives you a first class citizenship plus a say in the society. It's not all bad.

That being said, if I may bother you with one more question.
Lets assume that the 140 is revoked right after the employee leaves, and the employer had 100% abilitiy to pay the employee until that moment.
6 months after the employee left, and after the 140 was revoked, the employer gets an ability to pay RFE on some other pending or unrevoked 140 of theirs. In that case ,can the 140 that was revoked 5 months ago be in danger?
Of course, this is assuming that all AC21 memos till date are considered binding, and no memo changes to AC21 have happened.

You know, there are often times we all get upset that some stupid questions make it to the list, republican debate was one such yesterday, today's democratic one looked better. I hated that they did not ask our question inspite of it being the 2nd popular one but I personally think the question was too damn narrow for them to care.
For us, it may seem the world but for them it is just a technicality/one of the several points of CIR. Both Clinton and Obama seem to always chime in and act all gung-ho about legal immigration coming first.
Whenever they are asked about any frig'n immigration question, they throw the buzz word 'comprehensive immigration reform' and that folks, covers the entire gamut. The worst part is, on this issue the entire front runners look the same, well, almost. Mitt R is against but John, Hillary and Barack all seem to sing the same koom-ba-yaa song about CIR.

I would like to say few things for the rest of the posts, this debate will never end. Every person have their own opinions. I am trying to do my best to pursue my career. I don't think this is wrong. I have seen all kinds of people in my past 13 years experience. We cannot judge any person just by looking at experience/education or what ever... . This is my just my personal opinion.
