It is simple: you could have a PhD and be on H1B but still not qualify for EB2 classification if the job you are in does not require enough education and/or experience to fall under EB2 classification.
You do NOT require Master's degree for EB2 classification or for H1B. The law does require "related field" but does not clearly specify computer science or anything.
You do require enough experience.
When applying for GC or during the stages, Educational Equivalency to US accredited Universities will have to be shown. This is the stage you might have an issue with showing that it is equivalent.
There have been thousands of instances where applicants have been disqualified from applying for GC and even their H1B revoked when initial degree was found to not be related to the occupation - examples: B.Com, B.Sc (Bio, Geology..except Physics/Math), B.Arch.
USCIS is now very strict. :( -but for the betterment of the whole system.

People want to bash consultancies for their practices. I am currently trying to recruit a c++ programmer to work with me, and I find resumes on dice from US citizens and GC holders, most of these resumes are bloated to a large extent.
Resume bloating is a common practice, there will be very few honest people, it is upto the employer to do strict scrutiny on resumes.
Let us not associate resume bloating or consultancies with retro situation.

I have sent money using icicibank's M2I service . Usually they take 5 working days to remit the money(atleast 8 days to transfer). I made four transactions last week(mon, tue, wed, thu) and they already remitted the money using low conversion rate.
It just took less than three days to remit the money this time. Bank deliberately did this just to steal money from me. I have lost more than 35 paise per dollar and it comes close to Rs 10,000. This is ridiculous and its a big robbery.
How do i get my money back? How do i make a compliant about this bank? They have no one to assist me over the phone.
What to do now?. Rs 10,000 may look too small for us. But how can we let banks to act like a criminals.
Any help/suggestion/comment?

Of late is there anything of note even happening on the lobbying front? IV seems to have become another Immigration Portal kinda website where people are now posting all sorts of info, some of it not even immigration related.

IV now has clout which should be immediately used for a permanent fix. Two issues which might not require laws being passed can be implemented to ease the backlog situation that will be created.
1. Recapture lost Visa numbers- A just and reasonable demand that they cannot refuse.
2. Remove per country cap- It is stupid to look for diversity in a category based on intellect. The whole category is created for improving America's brain power so a country cap does not make sense.

We need to know if there is any light at the end of the tunnel. We need to know for how long we have to live our life in limbo. If there is hope than we need to be patient and plan to live like that for another 1-2 years. But if there�s no light at the end of the tunnel than we need to move on with our careers and other family commitments. Only your office and USCIS can help us by releasing statistics on the number and categories of applications pending with USCIS people waiting in this category can plan their lives accordingly.
It will be a great help if DOS or USCIS could tell us about the number of AOS application pending at USCIS along with their Categories(EB-3, EB-2, EB-1) and chargeable country.

Lets corner him on issues such as collapse of the Social Security system if number of Tax payers decreases, and how does he intend to stop it without increasing Immigration as American fertility levels are currently below replacement levels. We can ask him if he proposes the Government should increase taxes instead which will place him on a sticky wicket.

I seriously doubt that this list is a 140 pending. Not 485. In 485 stage NIW will not come into picture.
These numbers appear to be I-485.
1. I-485 is called application whereas I-140 is called petition. PDF mentions EB applications.
2. For EB5, no I-140 is needed. Instead I-526 is filed. Since EB5 is mentioned, it can't be I-140.

I just looked at my old cases(H1Bs-I-129) and i see LUDs on them too!!! This is so weird.

Fully agree with each word you said. Many people with legit US education (not TVU kind that many not so educated people on this forum are taking shelter under the umbra of) who have been in the US for more than 10 years are still lawfully waiting in the line. And this idiot with a BCOM and MCA ( correspondence course from IGNOU) is dreaming of porting into EB2 and screw us up. Shame on USCIS and Shame on DOL. I am really concerned that if legit EB2 applicants don't talk to lawmakers and send emails to USCIS, we will be stuck here for years due to these fradulent porting.

As someone mentioned on the other popst..DREAM ACT is for the children of illegal immigrants...not for the legal ones...
Yeah, we have to focus on long term relief. Getting AP and EAD is not a long term solution. I was hoping 'capturing unused numbers' or something better would happen with this July fiasco fix, does not seem to be happening now.
Hopefully this DREAM act will trigger more amendments like 'no limits on STEM EB visas' to get into pending bills...
