    Obama definately is not as articulate as Hillary.

    I am one of those people who is looking for a complete change.

    What if the change can not get anything done? Obama has no idea about foriegn policy.

    Ask Obama how he will fix legal immigration. First ask what are the categories of legal immigration. Lets see if can answer that.

    Billary was invited to an IITian rendezvous in San Jose. She was asked about the H-1B cRap. She gave one of the most intelligent answer I have ever heard and will ever hear.

    My parents visited last year. My dad had to undergo some treatments. ICICI never paid a dime. They kept me waiting for almost 9 months. Then finally decided it was a pre existing condition which isnt the case. I was just sick of calling these guys & finally decided to give up.

    I don't get this. Who is sponsoring this person's GC? He must have a sponsor to get the EB-based GC. He can't show his job skills as cooking !!:)

    A desi consulting company brought him to the US. When they realized he wasn't going to get a project, they just didn't let go of him. Since he was a reliable guy (1. he can be trusted with monthly grocery payment 2. his labor can be sold later to others 3. he servres as an insider who can get information if other consultants are trying to be sneaky by getting their resumes marketed by another company, etc etc, basically he is an asset even thought he doesn't have a project), they just decided to keep him there. These companies don't have attorneys. They take care of all legal matters themselves. Now, how much is hte USCIS fee to file for labor? How much to file for I-140? Peanuts right? So they continue to keep his application active. How hard do you think it is to get fake references when you can make fake resumes. They have fake pay stubs. Fake experience. Fake this and fake that. Everything they do is fake.

    So to others who have said that this thread has to be dropped, and have said that these desi companies are right in doing what they're doing, or who have blamed the system - I think that you are one of those people who are involved in such a racket. I know that I have touched your nerves by letting the whole world about this (not that some people didn't know this already). Why else would you want this thread dropped?

    I agree completely with the OP. Education should be rewarded. People with higher education should be rewarded likewise. PhD > MS > B.XXX. If you have done masters and possess higher qualifications but had to apply in a lower EB category it is your problem or the job you applied for does not require higher qualifications. Either way, it is not USCIS prob.

    I also agree with the fact the OP mentioned that MS folks and PhD folks who sweat out eventually end up losing more financially. This is the first time I am seeing some relief/reward for higher qualified people. I have seen people (have friends too) who came in 2000 straight on H1 and have been making big bucks since then and stuck in EB3. I have seen my friends port to EB2 and get GC. All this makes me feel like I have wasted 2-3 yrs in getting a masters. It is time we got rewarded. This does not mean I want others to be punished. I am saying people with higher qualifications need to be rewarded.

    Chanakya has posted very balanced views. Good job man. Lot of folks are bitter and have misconstrued your arguments and jumped right in to attack without even thinking.

    You are also right that very very rarely do you see a mature discussion in these forums. which is why I just keep away. I just laugh at the sillines that is often displayed here. People dont want to see what they dont want to see. Just few minutes back I saw a post where the OP claims to have entered the country in 1999, applied in 2004 and got his GC. He says he "has been waiting for 8.5 years". thats silly. he applied in 2004. so the wait is only 4.5 yrs. If that was the case I came to this country in 1999. I should have gotten the GC before his. should I crib about it now?

    Btw, I am in EB2. I made a choice to do my masters expecting some benefits. What use is the degree if it doesnt benefit me? No one would be going for MS and PhD if they are all same.

    Hi,I had my H1 revalidation visa approved on Dec 18th at chennai consulate but I have not received my passports till today (more than 7 working days).
    It seems PIMS check is happening only at chennai consulate in india.At mumbai consulate one of friend got passports on the same ay.

    Yes it applies for IV too. We have a handful of monthly subscribers because everyone wants the other person to pay for it. If the problem needs to be solved, each victim needs to fight this problem.

    Do let us know the outcome of your complaint.
    Please also inform others how you went about making this complaint.

    I have not been able to get even one personal friend participate in IV or donate to IV though they are enjoying AC21 benefits and work done by IV. Whenever I speak about IV they get angry and discourage further talk. They talk about EAD traacking, etc.... but are tight lipped when we talk about IV. Some stopped talking to me and say "it is because of IV" . Some say, "we do not believe in IV" but hideously visit IV website anonymously. It is nothing but hypocracy.

    While we all appreciate the contribution Aman has made for this noble cause and we are thanking him left and right on this forum, that is not the real appreciation of his sacrifice. Just saying thank you Aman; good job is not a real appreciation of his sacrifice by any stretch. If you guys really appreciate what Aman has done for us, please show your appreciation by making contribution. If Aman spent $64000, the least you can do is spend $64 on this noble cause which Aman has been fighting for all along.

    Well Said! I support you 100% and agree with you totally about this. Fraud is any program is unfair and unjust on everybody, including the H1 holders themselves.

    Your company is not a sample of the entire population. The H1B program is not on-demand program. It is once in an year annual event (because of the demand). US based companies when they get a new project which needs a position, if they cannot hire locally, cannot get H1B worker from overseas when they want. So, in anticipatory mode they have to get some numbers and utilize them and we do lose some H1B visas if they cannot bring them for various reasons.

    Is it fair, may not be. Is it widespread waste, I don't think so.

    Coming to market reality - how many US workers will join a desi consultancy company or India operations based company?

    these actions are not done "casually' or haphazardly"
    we have created these strategies based on advice and feedback from the offices of friendly lawmakers, advice from professinal lobbyists and our own experience so far. the "assistants" you speak too keep running tallies of phone calls on a given issue and these are communicated regularly to legislative directors and lawmakers. digital signatures and even digital petitions are given less weight- handwritten snail mailed letters on the other hand are treated with great importance.

    you may wish to google the nyt articles on how numbers usa operates to derail bills- they call! if our members would show the same enthusiasm and every single person would call when requested, we could have the same impact.

    one of the reasons we have not succeeded is precisely because folks want to use their own "intellect" and not do what "IV" needs when it really needs you.
    we do all of the above and more. if you like something more than the other that's perfectly fine and dandy. but if we can't collect a critical mass for an action, we lose effectiveness and shoot ourselves in the foot.
    in a group this large you simply have to help the commom action and agenda for success. each opinion is important but at the end of the day the common action must be done by all, as far as possible.
    paskal - i actually agree with your basic premise.....once the larger body agrees on a basic vision and strategic plan - the tactical manuevers to achieve the vision in line with strategy should be left to leaders.......

    but this principle generally works in two scenarios - either when the leader (or lead group) is appointed by a higher authority (like employees following the lead of a CEO appointed by board of directors which in turn has been "elected" by shareholders) or when the leader has been directly or indirectly elected by the constituents.......

    Let me give an example.......an entrepreneur starts a company with a great idea.....grows it and nurtures it with great love and passion......dedicates his whole life to the idea and the venture.......then the entrepreneur needs a larger canvas and more money to grow the vision further.......he takes the company public or gets private equity funding or raises debt........now the new owners/ stakeholders decide they need to change the management and decide to elect a person of their own choice........suddenly a rank outsider replaces the entrepreneur as CEO........the new CEO now has the legitimacy and owners' backing to dictate how the company should function.....

    I welcome red dots but take a moment to absorb what I am saying and whether the principle is wrong......
