I dont know if that's completely true. I had my H1B visa appointment on Dec 28th in Mumbai and am in the PIMS verification status also. The visa officer told me that all NIV applicants around the world have to go through the process and admitted that the process was new.
I talked to 3 other H1 candidates right after I was handed the yellow slip and they all had the same experience with different officers. Although its aggravating, hopefully, we'll all get some relief this week.

I sincerely believe NASSCOM should not ask Bush to raise H1B cap while he is there. It will create unnenecessary rukus in the U.S. media, and critics may contend that foreign institutions are trying to influence US immigraton policy.
Anyone with contacts in the Sofware Industry/NASSCOM please contact them (and Karnik) to let them know this will be counter-productive at this time. I'm not sure what these guys are thinking, sitting in their offices in Bangalore:(

The National Association of Software and Service Companies (Nasscom) will take up the issue of enhancing the H1-B visa cap for Indian IT professionals during US President George W Bush's upcoming visit to India.
The present annual cap of 65,000 H1-B visas for Indian professionals was far too low and needed to be raised substantially to meet the growing industry demand, Nasscom president Kiran Karnik told reporters in Bangalore on Tuesday.
"Though there are no great issues with the US, we are concerned with the existing cap on H1-B visas, which continues to trouble us," Karnik said.
He added, "This is something even the US corporations are concerned about and share with us."
"We intend to take up the issue with President Bush during his forthcoming visit to India (March 1). Since the US administration too understands our needs, we hope they address it."
"Indications are some moves are afoot in this direction," Karnik said on the sidelines of the second Sino-India software industry cooperation summit.
Recalling how the number of H1-B visas for Indian professionals touched a peak of 195,000 annually not long ago, Karnik said the Indian IT industry would be comfortable if the cap was more than doubled from the present level.
"We are looking at a cap substantially high enough to bridge the demand-supply gap. We want market forces to be the deciding factor as the Indian IT industry is the major user of the H1-B visa," Karnik pointed out.
The other major issue worrying Nasscom is the social security system or totalization agreement for Indian professionals working in the US under H1-B visa.
"Even the high fee structure for H1-B visas is concern for us because Indian professionals are made to pay up taxes for social security without any benefit. Since the H1-B visas are only for three-to-six years and social security benefits flow only after 10 years, Indians stand to lose out on them," Karnik lamented.
To overcome the problem, Nasscom has suggested the US government could refund the tax deducted under the social security system at the end of the work permit on the lines of some European countries.
"We are not against the deduction per se. Collect the social security tax, but refund the amount when the person leaves for home, as is being done by some Scandanavian countries like Finland and Sweden," Karnik affirmed.
In fact, Nasscom is in talks with more countries to introduce a similar tax system for the benefit of Indian IT professionals going abroad on work permit visas for onsite work or executing projects over a long period.
Nasscom also plans to bring to Bush's notice the urgent need to hasten the process of issuing H1-B and L1 visas.
"We are not against safeguards for L1 visas, but new restrictions should not be adverse. We agree L1 visas should not be misused. But the process should not take too long," Karnik said.
While H1-B visas allow companies incorporated in the US to employ professionals from overseas, L1 visas is more temporary in nature and is issued for transfer of an employee from overseas to the US.
In this context, Nasscom hoped the opening up of a US consulate in Hyderabad soon would benefit the Indian IT firms in reducing the time taken to process their visa applications.

If we have enough of that to guarantee a decent source of recurring income like 20 40 k or whatevr, I dont see the need to deprive some depressed soul surfing the net looking for some reassuring information from having to goto bed in peace.

The reason why change is not happening as much as we want is because we face tough opposition. The only way we can overcome this is by being stronger. We can definitely become stronger if all H1Bs, L1s, EADs etc come together on this platform. If each simply come, read posts, post comments and go away... it is tough to get anything done. Holding a rally is a good idea but we have seen how much work and resources are needed in planning and executing it. It can only be successful if several thousands turn up. Advocacy is a slow, long and painful process and requires lot of patience. Each member must take part in the advocacy effort and support ImmigrationVoice. The first step is to believe in IV. Believing in IV means believing in your abilities and the collective power of this community. There are many sharks out there with selfish or opposing interests who try to pull us down so that their own interests are served. Be a part of Immigration voice by supporting its monthly subscription if you cannot give your time to IV on daily basis. Join your state chapters and play a leadership role in organizing events to mobilize and increase membership in your states. IV will provide all the support and guidance you would need for lawmaker meetings. . IV is all of us. We all need to work together and make things happen.

What we really need is something like what they had to do to clear the US passport backlog -- aggressive hiring and reallocation of resources to remove the backlog + reassessment of the value of examining reference files. Not a replay of the DOL BEC story OR the continuation of the current Kafka-esque situation albeit with few pieces of duct tape to show the press.
I hope IV is making this clear in all meetings. $6M worth of changes are not going to fix the problem.

My apologies :eek:
I have checked receipt# and it was my wife's new H1 approval not my H1 transfer. Her H1 was returned to USCIS as non-delivered and I think this must be duplicate copy status update. We had received her H1 approval 3 weeks ago. Damn this USCIS is so slow to update their records. Two many petitions in my online portfolio leads to this confusion. I wish they could add one text box next to each petition and add my own description.

Not all professions can apply for H1Bs. You need to have specific skills that the US does NOT have. Someone on here had once posted that his wife could not work as a teacher although the school was ready to offer her a job, coz there is no H1B category for teachers. The H1B visa cannot help spouses in all professions. Hence my suggestion.
About how this will solve retrogression, IT WONT. My point is instead of trying to bring this retrogression beast down, maybe we should look at alternatives to work around it.
If it is not the skill that US does not have then what argument are we going to give to lawmakers for asking for such a provision ?
You need to restart ur GC process but you can keep ur PD (if not revoked) and get a 3 year extension immediately based on the Approved I-140.

Well, I used the pen tool and the circle shape tools (its a lot easier that way because you can drag the circle out from the center.. and you can find the center easily by using guides :) ) and they worked pretty good for me...
But that might be a little advanceced for someone new to photoshop.
