A filibuster by Republicans is in order if President Bush presses forward in the new Congress with legislation to establish a guest-worker program with a path to citizenship, says Sen. Jon Kyl, R-Ariz.
Kyl, however, speaking yesterday to nationally syndicated radio host Laura Ingraham, said he was uncertain whether or not Republicans would have the 40 votes necessary to block the legislation.
"I would certainly hope that the majority of Republicans in the Senate would not be complicit in passing legislation that is not wise, that for example, would put everybody on a path to citizenship and say that temporary workers get to get U.S. citizenship, and so on," Kyl said, according to HotAir.com
In January, Democrats will have a 51-49 majority over Republicans in the Senate. A supermajority of 61 votes would be needed to prevent a filibuster.
"I would certainly hope that we would have the 40 votes to be able to stop [the legislation], but, I don't know, we're going to have to wait and see; it'll be very close," said Kyl, who won re-election to another six-year term last week.
Arguing for the guest-worker program, the Bush administration has insisted it's not practical to deport the millions of foreigners who are in the country illegally.
"The cost of identifying all of those people and sending them back would be stupendous. It would be billions and billions of dollars," Homeland Security Secretary Michael Chertoff said in an interview last year.
"One of the reasons I think that we've been focusing on the idea of a temporary worker program as part of a larger strategy for border security is because it would be a way to siphon off people who really want to do nothing more than work here, put them into a regulated program � we would know who they are � we would then be able to send them back at the end of a period of three years or six years," he told Sean Hannity on the Fox News Channel program "Hannity & Colmes."
"They would have made some money, they could take it back home, and then we could focus our other resources on the people that don't want to do it the right way, and we could get those people sent out."
Last May, just 36 senators � three of them Democrats � voted against a bill that included a guest-worker program. The Senate was unable to work out a comprise before the Nov. 7 midterm elections with the House, which passed legislation rebuffing Bush's desire for foreign workers to gain legal employment.
Last summer, Rep. Mike Pence, R-Ind., announced a compromise plan called the "No Amnesty Reform Act," which would require all illegal aliens to leave the United States and apply at "Ellis Island Centers," operated by private companies in Mexico under a license from the U. S. government. They would then obtain a "Good Neighbor Safe Visa" qualifying them to re-enter the U.S. as "guest workers."

looking at the sarcastic, venomous and abusive responses, make me wonder why some people are so insecure and touchy. Why is there a my way or the highway mentality. Or may be some are happy living in illusion and don't wanna be shown some reality. couple of points

2) I got canadian PR not because i want to move there or anything. I got it cause its a good backup. If things dont go right in India, i can always come back for few more years. But this time it will be Canada. And before you guys start crying again, Canada has no problem with someone keeping a PR as long as he spends 2 out of 5 years in Canada.
Again, just the sheer number of people from India, China and Mexico running after PR ensures there is a long waiting line. No way around it. So either wait for your turn, or explore other alternative. If you want to spend time howling, crying and protesting, well good luck with that too. It only makes American look down on us as GC seeking lowly, noisy, needy immigrants.

I have a unique situation here. My original GC sponsor (a multi billion dollar industry leader) laid me off after 6 months of I485 due to lack of position in the company.
I ported my GC using AC 21 and joined another small consulting company. Now my GC is approved and I have an offer in hand from another company.
Will it be a good idea to move or do I have to wait for 6 months or 1 year before I make an employment switch.
My most important consideration is that there is chance of potential loss of job (may god forbid) with the current position. I may be able to save myself by switiching job right now. And of course there is more money on the table.
You are not with your sponsoring employer anyways, so take the new offer if you want. A piece of advice though, for such critical decisions, it is best to spend some money and consult an attorney, rather than muck about on IV and such. An hours consultation ( which all you should need), will cost you u2 may be 3 hundred dollars, but you will get proper advice.

2. The nicest IO i ever met at an INFOPASS at Memphis office. She is the one who really got it done for me as she spoke to TSC IO and insisted my case to be assigned. She also wrote email to TSC asking that case should be assigned as dates are current. There was a problem in Biometrics upload and she got is fixed too.
3. My congressman also called TSC but by the time the Memphis IOs email and call had me approved already.

The response is expected. Unless IV core members support nothing will move. Many similar threads came and go in past. IV is giving critical updates only to Donor members. So only donor members will know what is happening. Others will not know anything and will not have any direction. That may be one of the reason for poor response for these kinds of polls. If majority of the members are donors then that will be effective.

If the hosts dont even use 'controversial' to describe him it's pointless trying to call in - its going to be an 'immigrant hate-fest' whether you call in or not and you are not going to win hearts or change minds. 1) What does it really mean by withdrawing the I-485 ? Does it mean you withdraw only the 485 application and can reapply (just 485) it later when you are ready (when its current) ? Or does it mean the full GC process is cancelled, which means you have to start with your labor again at later point of time?
2) What are the real benefits of applying now for I-485 in my scenario? If I get married after the 485 is filed, it sounds like I am forced to anyway maintain my H1B till I get my spouse on H4. Also to apply for my spouse�s 485, my PD must be current at the time of filing. If not, then again I am forced to maintain my H1B till the dates become current.

There are so many stages where you can apply the breaks. Like if you get your FP too soon..you can reschedule the date or even withdraw the I-485 application later. Other option is to convert to CP. There are so many options and talk to your attroney.
I feel you should file now, try to do civil ceremony done in india in 30-45 days so you are safe.
