Let's pick up where we left off before this July 2 visa bulletin debacle (and the resulting struggle). Though the whole fiasco did get us our first taste of success, imho, and as such isn't insignificant by any measure.

Let us do that. Please!! We can't stop now. We need to fight to fix the broken system. Let's get ideas on what all we would like and suggest to core. I am sure they know already but it helps to know what everyone else is thinking, right?
1) I would like to get opinion from CORE if we need to support the SKIL bill that is being re-introduced by Senator John Cornyn
2) Need to have a way to re-capture visa numbers

It took almost 4 1/2 years to get the labor certification and now its almost 17 months since my I-485 is pending approval. Took the path of writing to the FL, State Senator, Local Congressman and was fortunate to receive their response suggesting that its stuck in the namecheck stage and will have to wait for it to be completed. It has become a nightmare.... The only update in my case used to be whenever I initiate a service request. Now what is that which I can do to come out of this riddle....
Any suggestion in this regard is highly appreciated !!!!

I think some of our members put the votes in wrong place.
For Eg : for "Before Nov 01 2002" right now the number of votes are 24 click on 24 you will see which user voted for "Before Nov 01 2002 now check for couple of users for their Labour Approval Date some have labour approval dates of 2006 and 2007

Hi guys,
Today morning I was able to reach IO in Texas service center, she is very friendly and helpful. I had two I-140s one with EB3 and another one with EB2. She mentioned that both are not current, I explained her about the PD portability rule and about my letter of request to port priority date.
She said she is not aware of that and asked me to sent the Memo and gave her name and Fax number. I faxed related pages in that memo to the fax number provided. She also mentioned that she will send request I-485 processing unit and will add the comments about the PD portability. Also she mentioned that she will discuss about this PD portability with her supervisor.
Hope this help. I strongly recommend the guys who are current to call USCIS and find the case status.

Recapturing lost numbers is not a permanent solution. Per country limit 7% is ridiculous. We need to make sure we are not discriminated against by the per country limit. Its not my fault that someone from Europe doesnt want to come here and not so many from Africa or south america qualify for the EB visas.

While I was waiting for GC, I finished MBA last year. I have a Masters degree in Comp. Sc. also. It has been 4 1/2 years with no clear indication regarding the LC alone. Hats off to the screwed up concept of BEC. If my LC is not processed in time, I might leave next year.
I am thinking of doing a part time job on H-1B also. If that pans out well, atleast I will forget the pain of GC for a while.

Unfotunately what you are saying sounds cool except that its not true.
Job offer has to be valid on the day petition filed or the specific date mentioned.
If the job offer no longer exist, employer need to withdraw the H1. Until and unless employer does so, he is on hook to pay the employee.
The only argument against employee here is , employee did not report to work. If employee can prove (through email copies etc) that he actually tried to report but employer barred him, employer must pay the wage till the date H1 was sent for withdrawal.

For example, if the petition has a start date of Oct 1, 2010, and the petition is not withdrawn, employer is stating that he has a valid job opening starting October 1. No additional job offer/invite is required. The only time such invite *May Be* required (at PoE) is if the employee is travelling much later than the start date specified in the Petition.

I wont get into EB2/EB3 fights, but tell you what my opinion about this is.
The law definitely supports interfiling and priority date porting. However, this is like reserving seats on a bus by throwing your handkerchief in good old India. It is unfair to let people jump ahead in the queue, even though they acquired the eligibility to file in EB2, at a far later date.
There might be some genuine cases where people could not file in EB2, even though they were eligible. I only support these cases.
I've a pending EB2 485. However, let me be honest. If I had EB3 to start with, I too would've interfiled in EB2 and would've ported my priority date. Who wouldn't do it if the law allowed them to!

Meanwhile, I printed out AC21 IV campaign letters and went to each of my co-worker at my work-site and convinced them to send it. Hopefully atleast some of them will send it. Thanks for your effort on behalf of our "descriminated based on country of birth community" :)

how long after the soft LUDs did you get the hard LUD (RFE)?
And what was the RFE for?
I had a soft LUD on 3/19/09.

My PD is EB-3 I, Mar 2004 and no way closer to being current.
