You need to relax and change your tone. This tone is very inappropriate in this forum. We are here to ask questions. You have no right to talk to people like this. Just because we are trying to understand a very obvious change in policy from USCIS, it doesn�t mean that we are against you or anybody in the same position as you. I am happy that EB2 India has established a cutoff date, but I can still ASK questions on this forum. Stop patronizing people and CHANGE your tone.

Ok, clearly you did not read what I wrote or you did not understand it. Here is what I wrote..
"Well, I don't think gctest is against EB3. He is against consultants from sleazy bodyshopping companies, which is right.". Some one left me a red saying "not all consultants from sleazy bodyshopping companies are incapable." I agree and I never said that. If I came across that way then I apologize.

There is diversity visa for that.
The intent of US immigration (employment or otherwise) is to import diverse population such that it benefits US in various different ways (socially, culturally, economically). Employment category comes under the larger umbrella of such goals.
Put yourself in ROWs shoes and if you claim that you still believe in abolishing the quota, then I will agree you are a great person. I am not, because if I put myself in their shoes, there is no way I will support this action.

2008- LEVEL II : 4000
2007 - LEVEL II : 11495
2006- LEVEL II : 14616
2005- LEVEL II : 841
If you add-up these figures it comes to Total EB2 PERM:: 30,952. Now remove 2008 ( 4k) and some people ( 5k) uto 2006 got their GC's by last year. So that figure does come to very close to what Senator letter is saying.

I'm July 2007 filer and per the Aug visa bulletin my I-485 application is current (PD - Feb, 2006). I raised a SR with NSC on 15-Jul to find out the status of my application and here is the response I got from them today:
The processing of your case has been delayed. A check of our records establishes that your case is not yet ready for decision, as the required investigation into your background remains open.
Until the background investigation is completed, we cannot move forward on your case. These background checks are required to be completed on all applicants who apply for the immigration benefit you are seeking. We will make every effort to make a decision on this case as soon as the background checks are complete. If you do not receive a decision or other notice of action from us within 6 months of this letter, please contact customer service at the number provided below.
I'm kind of worried as I haven't seen folks getting this response. I haven't gotten even a DMV ticket and not sure why would I get that kind of response. Please advise what should be my next course of action and if there is anything I can do from my end.

Is it correct to say only nebraska Service center is issuing the rfe because they are pre adjudicating while Texas service center is not issuing rfe because they are not pre adjudicating 485. A vast majority of people getting rfe on 485 (95% or more) are from nebraska Service center.

Why
Silicon Valley is the world’s most advanced crucible of innovation, an example that countries all over the world have tried to emulate. With this effort, the skilled, legal immigrant community hopes to create awareness about their predicament and express their anguish and frustration at the reversal and the lack of action from the Government. These are the highly skilled workers who have been driving the innovation in the US for many decades and have been living in this country legally and yet, they feel that their issues, concerns and contributions to the economy have largely gone unnoticed. According to exhaustive research done by Vivek Wadhwa, executive-in-residence at Duke University, if highly skilled immigrants in the U.S. don't have a chance to stay here permanently, would-be entrepreneurs take their skills back to their home countries—where they compete with U.S. companies instead of founding them.
There are 140,000 Green cards allocated for highly-skilled workers and their dependents in a fiscal year (unused visas may not be rolled over to the next year). However, due to over-subscription, thousands of highly-skilled workers, including engineers, scientists, MBAs and health care professionals have been waiting patiently for years in order to be eligible to apply for their Green cards.
Now, these highly-skilled professionals have decided to call attention to the "broken" immigration system in the U.S. for legal immigrants. Earlier this week – the community received widespread attention when hundreds of them sent flowers to the USCIS Director, Emilio Gonzalez. With the San Jose rally, the community of skilled, legal immigrants wants to put focus on people who have abided by the law, played by the rules and ask for a fair treatment and attention to their issues.

I guess it has less to do with estimates, and more about looking at the landscape. If there are significant portion of responses are above your date, one might, for example, choose to initiate porting/reclassification process if one qualifies for it.

You probably can't ask to stop portability from EB3 to EB2 or EB2 to EB1. But you can ask for if filers from EB3 goes to EB2, they can't keep the PD from EB3 but get a new PD for the date USCIS process their EB2 application.
That will make people really think if that is worthy to do so. Otherwise every EB-3 filer will want to file again for EB-2 if they can.
You can ask all you want about not allowing porting from EB3 to EB2 or not letting keep the priority date in doing so. IV is not going to endorse it. Reality is job done by EB2 or EB3 especially in IT is very much alike.
Moving from EB3 to EB2 is for worthy cause of getting GC faster in legitimate and ethical way.
