Just a 3 years in USA, getting a GC by porting into EB2 with a B.Com and some online degree!!!!!! What a pathetic situation for us!!!!!!!!!. Wake up USCIS!!!!!!!!!!!!
I work for intel, there are quite a few guys with under graduate degrees in Mathematics (though I will say that not anyone from India, that I know of) on H1b and I dont find them inferior to any of us 4 year BE employees. Secondly, I also dont agree to the online degree comment as well. My collegue just finish his Masters from North Carolina University and I can say it was not easy...

the local service center lady said - Assigned to an officer on 9/11 - now HOW MUCH OF A WAIT AFTER ASSIGNED TO AN OFFICER? recent approvals folks - can you shed some light?
you should get it soon. Call the service center where your case is to check further as online status is not a good indicator. In my case per TSC i was approved on 9/4 but my online status did not change until 9/11.

They might have found some irregularity or discrepancy in your current petition! Never heard of something like this before though!
Please consult a lawyer Your question is better answered by him!
Good Luck
hey aviko21 ...
Thanks for the reply....You may be right ..in that they must have found some discrepancy in my current petition....but if that is the case ..should'nt they raise an RFE for the current H1 petition which is pending....rather than re-opening an already approved case ???

If an American citizen wants 100K and the GC holder wants 90K and the H1-B visa guy wants 80K (and all of them are going to work in the same city and same office) the job is worth 80K.
I would strongly disagree that H1 = cheap labor. It's only the H1B employer who pays low salaries, where as the client pays the same billing rate to all contractors (including US citizens). If a h1 employee is getting a low pay, then there's no one to blame except the employee, cuz he's allowing himself to get exploited.
I work for a major US corporation. I have seen H1 - LCA notices on my office notice board with salaries ranging from $100K to $110K. I personally know a friend who earns $100K on H1 and also an US citizen who earns $85K in the same office.
I have seen H1 holders driving Merc/BMW, whereas GC holders/Citizens driving a rundown Honda or Toyota Corolla.
Recently, one of my friend left his desi employer who was paying him $75K per annum and joined an US corporation by doing a H1 transfer for an annual salary of $135K per annum.
It all depends on your skills and how benefitial you are to the company. If you wanna reach the stars, then no one's gonna stop you.

Hello:
I am working on EAD for company B. Company B filed H1 transfer for me before May 2007. I heard that You can transfer you H1 and EAD both with new company but I did not aware about this rule, I started working on EAD. Is it possible to go back on H1 which company B filed? I have not yet used AP for travelling abroad.
Regards,
AFAIK, once you work on EAD, you can not be back on H1B. Please check this with your lawyer.
However what I do not know, and what my lawyer also could not answer till this point is, if after travelling abroad using AP, can one transfer same H1 to a new employer? I know it is possible to continue working on H1 with the same employer. But what if one need H1 transfer?

some sort of recapture is better than none !!! we should try to have some relief for EB but let us not stand in the way of FB ..the reason is simple, unused FB visas overflow in to EB (if I am not mistaken) ...In fact that is one of the reason that EB2 India did not move much this year since they are more efficient with FB visa this year (see the pace at which it is moving this year as opposed to last year) so better to wait and watch.
(my post is in response to h1tech's post on the first page)
Recapturing unused EB visas and allocating them to FB is absolutely not a good idea for EB category people. If such a thing happens then there will be no unused visa to be recaptured for EB.

H1-B has the following advantages under certain conditions.
1) If you are not yet married, you dump H1 and you are dumping the ability to bring your future wife to US immediately after marriage.
2) Some states give driving licenses that is valid until the EAD expiry or H1-B I-94 expiry. With H1-B, your hassle of DL renewal is reduced to one third of EAD based.

But Mr Sanju you do use foul language towards other members.Sometimes your comments cause admin to close the thread. Remember the reponse you gave to Mirage for his post regarding calling senator for country cap. You need to show some control over your emotions and excitement.
And you dont have to respond to every single post with your EXPERT comments
I do not intend on posting something for anyone's wife/hisband and children because that is not who I am, but I want to make sure you enforce the same rules here as you enforced on me the other day.

just presenting a possible reason why what paskal proposed in his post does not work well in IV.......its not a question of whether phone calls are important or not....its a question of making a significant number of forum stakeholders (and not 1-2%) get to act on any initiative......fund raising/ calling efforts etc....
i genuinely believe that the core members go above and beyond whats expected to do what they are doing for IV - its truly remarkable...they all have busy lives and it takes great conviction and dedication to take the time out and do this...but why are the people still not responding despite the obvious pitfalls of not acting on GC related initiatives.......
maybe its lethargy, inaction, indifference etc.......but we should be open to considering that just maybe, a vast and silent majority of IVians do not feel a sense of representation in the organization and hence do not react as enthusiastically as they should........legitimacy among the constituents often comes with representation
why did most kingdoms around the world perish and give way to democracies......bcos the kings taxed the public based on their whims and fancies......elected govts may do the same but people still pay up and if they dont agree - they know they have a choice at the next elections.......
and no, i dont deserve to be the CEO - neither do i have a performance track record nor credibility here......should not stop me from voicing a contrarion view though
ill be the first to support you on that. nobody should stop anybody from expressing their point of view. i provided mine too. its just that, an opinion.
my disagreement is basically with the thread's premise. its not an "absurdity" to call lawmakers. in fact, its probably more absurd to think that this is absurd. my point in a nutshell was for us to be constructive.
ill just conclude with the exact words from the numbersusa spokesperson to its members following the recent events and this is on the top of the message, emphasis mine :
Your Phone Calls Worked!
So, there you go, need i say more? Good for them. They worked hard, were focussed on the task, made more calls and things went their way. Of course, we did have the Ag jobs bill which wasn't pretty to be hanging out with. Anyways, if you want, you can read the entire statement by using your favorite search engine.

I see DOL making so many improvements, PERM process in full gear, BECs finishing up most of their backlogs, and then, no labor substitution rule. Hope USCIS takes some inspiration from them.

1. I was wondering how this rule would affect people like me. My labor has been approved and its been about 50 days. I will be applying for I-140 this week. Will this 45-day rule affect me?
2. If what is stated in immigrationportal about the labor substitution is true, then we don't have any real benefit from the this rule, because all labors certified before the implementation of this rule are not bound by the 45-days time constraint?!? All the so called desi companies may not sell the labors, but would not spend money to cancel it either. So those old labors are going waste as they are still active.
The cut-off date is determined by #485, not LC.

Having seen numerous threads in which the exchanges became rude/sarcastic/rude or even outright abusive and vulgar, I was hoping that this would not become one.
Ron, while you may have a point in what you say, sarcasm and taunts will get you no where. As you said, the 'antis' are gearing up, suggesting (I presume) that the effort of all of us should be more concerted and determined. But you are not doing yourself any favor by saying the things that you do.
Raji had a point of view, and has not been rude or offensive in expressing it. In fact, her/his first post was out why it is not good to use the AILA template. Well, PASKAL did try to address. Raji's tone or tenor of posts did not merit a peremptory reply, much less a rude one.
Be that as it may, I do believe fervently that even if someone insists/demands an answer, you can always ignore it instead of being rude or aggressive.
That way there will be more people on IV'S side.

i personally vote for "one step at a time approach", which is been thoughtfully discussed and hand-picked , especially after thinking all the limitations we have in terms of $$, political support, member support, contribution support, etc etc
remember:
on every bill and every single effort we try to make after all these pains, every single mistake we make will cost us 6 months or more before we re-group educate memebers and others about what we can ask for in the next and satisfy IV members.
filling up bills with each and every single problem has taught us some lessons. so we decided to go small to see how it works. every single retro prob has dependancy on others. so as logiclife mentioned solving one will ease the other one or indirectly solve other issues. im not that good in explaining all those, but i can try one.
EG: see the scenario where H1B is not happy seeing H4 not being able to work. If our I-485 filing provision gets through, he/she can apply EAD for his/her dependant and all are happy.
dont always think "H4's cant work" "H4's cant work" "Compare with L1's".
im sure core team might have thought thru about a million times what needs to be done, when and how with all our limitations.
its a matter of just 15 days wait to see what we get. why throw in more and confuse people. dont we have even a little patience?
remember, one thing for sure - every single mistake we do from now on - the waiting punishment may be in years. and its for sure the retrogession will be solved in the future sometime, but no guarantee- in our living time in usa.
pardon me for any grammer / typos. im not used to this kind's big response

We should send at least 100 emails via change.gov to Mr. Obama's team on Legal Immigration.
http://change.gov/page/s/immigration
Please urge new administration to support three bills by Joe Lofgren: HR 5882, HR 5921 & HR 6039 . This will be very helpful.
1. log on to change.gov, create your profile (use a legal email addresss)
2. go to http://change.gov/page/content/openf...tions20081229/
input "legal immigration" and hit search questions and vote for all legal immigration questions
3. You can also post your own question
Why to change gov
Why not to force to declare clarance date e.g. by today Since Dec2001 not a single file is pending.
